Terms of Service

1. Agreement to Terms
By accessing or using Movra Connect ("the Service"), operated by Qualiency ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
Movra Connect is a SaaS platform that enables fitness and dance studios to manage client communications through the WhatsApp Business Platform. The Service includes AI-powered message handling, contact management, broadcast messaging, template management, and integration with booking systems.
3. Account Registration
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the security of your account credentials.
- You must be at least 18 years old to use the Service.
- One account per studio. Each workspace represents one business location.
4. WhatsApp Business Account
- To use messaging features, you must connect a WhatsApp Business Account through Meta's Embedded Signup flow. You authorize us to manage your WABA on your behalf.
- You are responsible for complying with WhatsApp's Business Policy and Commerce Policy.
- You must not use the Service to send spam, unsolicited messages, or messages that violate WhatsApp's policies.
- We may suspend your messaging capabilities if Meta flags your account for policy violations.
5. Acceptable Use
You agree not to:
- Send unsolicited bulk messages or spam through the Service.
- Use the Service for any illegal purpose or in violation of any applicable laws.
- Attempt to access other users' data or workspaces.
- Reverse-engineer, decompile, or attempt to extract the source code of the Service.
- Use the AI agent to generate harmful, misleading, or deceptive content.
- Exceed rate limits or abuse API access in a way that degrades the Service for others.
6. Subscription & Billing
- Movra Connect offers a 14-day free trial. After the trial, a paid subscription is required to continue using the Service.
- Subscriptions are billed monthly via Stripe. Prices are listed on our pricing page and may change with 30 days' notice.
- You may cancel your subscription at any time. Access continues until the end of the current billing period.
- Refunds are not provided for partial billing periods.
- WhatsApp conversation charges from Meta are billed separately by Meta and are not included in Movra Connect subscription fees.
7. AI Agent Disclaimer
The AI concierge agent is an automated tool that responds to client messages based on your studio's configuration and knowledge base. While we strive for accuracy, the AI may occasionally generate incorrect or inappropriate responses. You are responsible for reviewing AI-generated communications and maintaining human oversight of your client interactions. We recommend keeping the human handoff feature enabled for complex inquiries.
8. Data Ownership
- You retain ownership of all data you upload or generate through the Service.
- We do not use your message content, contact data, or business information to train AI models or for any purpose other than providing the Service to you.
- You grant us a limited license to process your data solely for the purpose of operating the Service.
9. Service Availability
We aim for high availability but do not guarantee 100% uptime. The Service depends on third-party infrastructure (Meta WhatsApp API, Supabase, Vercel) and may experience downtime due to factors outside our control. We will notify you of planned maintenance in advance when possible.
10. Limitation of Liability
To the maximum extent permitted by law, Qualiency shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
11. Termination
- You may terminate your account at any time from the Settings page.
- We may suspend or terminate your account if you violate these Terms, WhatsApp's policies, or if required by Meta.
- Upon termination, your data will be retained for 30 days, then permanently deleted unless you request immediate deletion.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or through a notice in the application. Continued use of the Service after changes constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of Singapore. Any disputes shall be resolved in the courts of Singapore.
